His lawsuit says he was “the first to file a device so designed and aggregated as to have created a novel combination of media and communication tools… whose identity was, since then, hijacked and exploited by Apple’s iPhones, iPods, iPads and others”.

Ross’s patent was never actually approved, given that he failed to pay the appropriate fees, and the application was declared abandoned in 1995. Nonetheless, he claims Apple resorted to “dumpster diving” when designing the iPhone and subsequent devices.
“Instead of creating its own ideas, Apple chose to adopt a culture of dumpster diving as an R&D strategy,” Ross’s lawsuit says.
Apple dug in against that the FBI and US Government. So yeah, of course Apple will rollover and pay this piece of stupidity.
I was there and it is true. Mr. Ross had communication with the inhabitants of Krammelfarb. They showed him the design after they captured him. He couldn’t pay the patent filing fees because he needed bus fare home.

What a pointless waste of time and money. If he thinks Apple stole his design then he should probably be lining up behind Palm, Compaq, Blackberry, Toshiba, etc. who all designed and manufactured devices that looked a lot like his design but actually made it beyond rough sketches in a note book to become real products!
Come to think of it, why wasnt he suing those companies when they came out with their devices all those years before the iPhone?
Sure, nobody could ever possibly come up with a rectangular thingy with a screen and buttons unless they had been “dumpster diving” and found this particular geniuses drawings…
