Twitter forces Twitpic to shut down

A few weeks ago Twitter contacted our legal demanding that we abandon our trademark application or risk losing access to their API. This came as a shock to us since Twitpic has been around since early 2008, and our trademark application has been in the USPTO since 2009.

Damn Twitter.

  1. So, if I understand this correctly, since Twitter seems to have exercised eminent domain over the prefix “twit”, we’re now required to refer to all of Twitter’s legal and management team as a collection of “massive fucking twits” or risk losing access to their APIs…

  2. It was created entirely to extend the functionality of twitter, and given a name expressly based on twitter’s with no permission from the company. They should never have expected to win a trademark on the name. In fact, Twitter probably would have risked a dilution of their own trademarks if they hadn’t acted.
