Apple has claimed they exhausted the patents on behalf I all app developers when they licensed the tech from the original ownersl Since they haven’t been directly sued they can’t apply this defense. So this is as good as can happen for the moment.
Unless they figure out some way to find a class action for harassment. Or something similar.
